Kano Court Bans Arrested TikToker from Social Media Use

A High Court in Kano State has banned a popular TikToker, Murja Kunya, from using all social media platforms as part of her bail conditions.

The ruling was made by Justice Nasiru Saminu while considering her bail application on Monday, March 25, 2024.

Kunya, who has been in custody since February 20, was arrested by the Kano State Hisbah Board, the state’s Islamic police, on charges of misdemeanor, improper conduct, and immoral behavior, which are contrary to Islamic laws of morality.

Justice Saminu granted Kunya bail in the sum of ₦500,000 with two sureties, one of whom must be her blood relation, while the other must possess a landed property within Kano metropolis.

The judge also ordered the Commissioner of Police to arrest her if she violated the ban on social media use.

The case has been adjourned to May 16 for continuation.

The court’s decision has sparked controversy, with many viewing it as a violation of Kunya’s fundamental right to free speech.

Human Rights Activist, Aisha Yesufu, criticized Hisbah’s focus on the TikToker, arguing that the organization should be more concerned about child welfare and support, rather than targeting individuals like Kunya.

In her X post, Yesufu expressed her disappointment with Hisbah’s priorities, stating, “Hisbah should be ashamed of itself and the political sharia it practices.

Children are roaming the streets abandoned by their parents and that is not the focus of Hisbah. Neither are they focused on child support that is not being paid. It is Murja that is their problem.”

The case has garnered significant attention and raises important questions about the balance between religious laws, freedom of expression, and the role of law enforcement in a diverse society.

As the case continues, the outcome will undoubtedly have implications for the future of social media use and freedom of speech in Kano State and Nigeria as a whole.
