The verdict of the Abuja Court of Appeal confirmed that Uba Sani of the APC is the rightful governor of Kaduna State.
On Friday, the appellate court’s three-judge panel ruled that the tribunal made a mistake when it relied on evidence that was not valid to demand supplementary elections in 22 polling units across four LGAs where the outcome was not clear.
The court said that the PDP’s main witness at the tribunal hearing only gave second-hand testimony as he was not there when the wrongdoing he claimed occurred.
The appeals court said that the witness’s accusations of vote reduction, ballot stuffing, and tampering with crucial election materials were based on hearsay.
The court also said that the tribunal was correct in throwing out the petition of the PDP and Isa Ashiru because the petitioners gave up on their petition by not applying for a pre-hearing information sheet after the end of pleadings, as mandated by paragraph 18(1) of the first schedule to the Electoral Act 2022.
