Apple Watch Sales Ban Set to Resume After Court Ruling

The sales ban on Apple Watch Series 9 and Ultra 2 models is set to resume on January 18, 2024, at 5 p.m. EST.

The ban, which was temporarily halted, will now be reinstated after the U.S. Court of Appeals for the Federal Circuit denied Apple’s request to stay the ban pending an appeal.

The ban is a result of a patent dispute between Apple and technology company Masimo over blood oxygen sensor technology.

The International Trade Commission (ITC) ruled in favor of Masimo, leading to the ban on the sale of Apple Watch Series 9 and Ultra 2 models in the United States.

Apple had initially removed the affected watches from its online store and Apple Store locations, but the ban was temporarily halted, allowing the company to resume sales.

However, with the ban set to resume, Apple will once again be unable to sell the latest models of its popular smartwatch.

The Apple Watch Series 9 and Ultra 2 will still be available for purchase at some US stores starting on January 19, 2024, with wider availability rolling out in the coming days.

However, once the ban is fully in effect, Apple will not be able to sell the Watch models with the blood oxygen sensor.

Apple is appealing the ITC ruling and has filed an emergency appeal motion to overturn the ban. The company has also submitted a redesign of the Series 9 and Ultra 2 watches for U.S. Customs approval.

Apple hopes to resume imports of the most advanced watches as soon as possible.
