Wife seeks divorce over frequent Assault

A house wife, Kafayat Jimoh, has filed a suit seeking to divorce her husband, Yusuf Aliu, over alleged frequent misunderstandings and battery.

Kafayat, in her divorce seeking application before an Area Court, Center-Igboro Area, Ilorin, said she was legally married under Islamic injunction to the defendant in 2019 and blessed with a child.

But she pleaded with the court to grant her request because there was no more love lost between them, accusing her husband of constantly physically abusing her at the slightest misunderstanding.

The presiding Judge, AbdulQadir Ibrahim, noted that the defendant had consented to the petitioner’s request through “a set free note to court, agreeing to divorce the petitioner”.

Ibrahim accordingly dissolved the marriage and ordered the petitioner to observe three months Iddah period before could re-marry.

He also warned that both parties must undergo another marriage rite should they decide to live together as husband and wife in the future.
