NDPC’s Registration Notice for Data Controllers and Processors

In a significant development for data privacy in Nigeria, the Nigeria Data Protection Commission (NDPC) has announced a mandatory registration notice for all entities that collect and process personal data of individuals.

This includes businesses, educational institutions, healthcare providers, and other organizations.

The announcement, made on February 10, 2024, comes in accordance with Section 5(d) of the Nigeria Data Protection Act, 2023.

The NDPC aims to ensure that all organizations handling personal data comply with the necessary regulations to safeguard the privacy of individuals.

Data controllers and data processors are required to register with the NDPC to continue their operations. Failure to comply with the registration requirements may result in penalties.

Organizations that collect and process personal data such as students’ records, client information, patient details, customer data, or any other personal information must register as either a Data Controller or Data Processor.

The registration process can be completed through the official NDPC Registration Portal at www.service.ndpc.gov.ng (http://www.service.ndpc.gov.ng).

The registration period will begin on January 30th, 2024, and close on June 30th, 2024. Entities that fail to register within this timeframe will be subject to penalties.

Under the Nigeria Data Protection Act, 2023, it is illegal to process personal data without proper registration. Failure to comply with registration requirements constitutes an offense punishable by law.
