Landlord Faces Court for Disconnecting Tenant’s Utilities: A Breach of Peace?

A 64-year-old landlord named Samuel Famakinwa was brought before an Ejigbo Magistrate’s Court in Lagos for allegedly disconnecting electricity and water supply from a tenant’s apartment.

The landlord is facing a three-count charge for breach of peace and unlawful disconnection.

The incident, which took place in October 2023 at No. 9, Asungbolu St., Igando, Lagos, has raised concerns about the landlord’s conduct and the potential breach of the tenant’s rights.

The prosecutor, ASP Benedict Aigbokhan, stated that the defendant’s actions were in violation of Sections 168 (1) (d), 247, and 340 of the Criminal Law of Lagos State, 2015.

Despite the charges, the defendant pleaded not guilty to the accusations.

The court granted the landlord bail for ₦50,000 with one surety in like sum.

The surety is required to be gainfully employed and provide evidence of tax payment to the Lagos State Government.

The case has been adjourned until March 11 for mention.

This case highlights the importance of understanding the rights and responsibilities of both landlords and tenants in Lagos State, as well as the potential consequences of overstepping those boundaries.

It remains to be seen how the case will unfold, but it serves as a reminder for all parties to be aware of their legal obligations in such situations.
